Idea from a TV show, legal?

(trying not to give too much away so sorry if its a little unclear)

I have had an app/game idea based on something I saw in a TV show.
The TV show is a comedy and what they are doing (which is what i got my idea from) is made up, its just a joke and what they talk about is all a load of rubbish.

Since it doesn't exist, or make any sense for that matter, can I put the idea into reality and make it into an app? or because it was mentioned in the show, will it be classed as copyright?
I hope this isn't too confusing

    It would almost certainly be considered trademark/copyright infringement. This is a creative idea thought up by the writers of the show -- you must not use their idea without permission.

    What? No.

    An "idea" is not copyrightable or otherwise protected unless you patent it. Nor is "look and feel".

    In order for there to be infringement you either have to violate a registered patent, use a trademark (either registered or unregistered), or use creative or technical assets from the source.

    The only caution would be, if the idea was expressed as

    "Hey, wouldn't it be cool if there was an app that allowed you to track how many drinks everybody in your group has had. You could call it DrinkTrack!".

    then you probably shouldn't call your app "DrinkTrack", and you shouldn't copy any icons, logos or whatever that they might show onscreen if it was visualised.

    But there would be nothing stopping anyone from an app that allowed you to track how many drinks everybody in your group has had.

    Unless you use the name of the show or take anything which can clearly be attributed to the show, you're good to go. And basically what ^ said.

    He IS talking about something that can be directly attributed to the show, not some random concept.

    As I said, that only matters if he copies the name of whatever they called it.

    You can't copyright a concept or idea. That is why clones are happily prevalent on the App Store. You have to patent it. And I highly doubt they have.

    As long as he doesn't infringe on a trademark (including not having "as seen on TV show xxxx") or steal a creative asset then he is fine.
